Terms of Service & Platform Policy

A comprehensive legal framework protecting Donors, Campaign Organisers, and the integrity of the Social.fund ecosystem.

Section 1Introduction & Acceptance of Terms

1.1 About These Terms

These Terms of Service and Platform Policy (“Terms,” “Agreement,” or “Policy”) govern your access to and use of the Social.fund website located at https://social.fund (the “Platform,” “Service,” or “Site”), operated by Social.fund (“we,” “us,” “our,” or the “Company”).

1.2 Binding Agreement

By accessing, browsing, or using the Platform in any capacity—whether as a Campaign Organiser, Donor, Beneficiary, or casual visitor—you acknowledge that you have read, understood, and agree to be legally bound by these Terms in their entirety. If you do not agree to any provision herein, you must immediately discontinue your use of the Platform.

1.3 Scope of Application

These Terms constitute a legally binding agreement between you and Social.fund. They apply to all visitors, registered users, campaign organisers, donors, beneficiaries, and any other person who accesses or uses the Platform in any manner.

1.4 Acceptance Through Use

Your continued use of the Platform following any amendments to these Terms constitutes your acceptance of such amendments. You are responsible for reviewing these Terms periodically to ensure you are aware of any changes.

1.5 Capacity to Agree

By using the Platform, you represent and warrant that you have the legal capacity and authority to enter into this Agreement and to comply with all of its terms and conditions.

Important Notice

These Terms contain a binding arbitration agreement, a class action waiver, and a waiver of collective claims against the Platform for enforcement actions taken to protect Donors and the ecosystem. Please read Sections 10, 11, and 18 carefully.

Section 2Definitions

2.1 Platform & Service Definitions

  • “Platform” refers to the Social.fund website, its subdomains, associated mobile applications, APIs, widgets, and all related services.
  • “Service” refers collectively to all features, tools, and functionalities provided by the Platform, including campaign creation, donation processing, and communication tools.

2.2 User Role Definitions

  • “Campaign Organiser” (or “Organiser”) refers to the individual, entity, or group that creates and manages a Campaign on the Platform.
  • “Donor” refers to any person who makes a monetary contribution to a Campaign through the Platform.
  • “Beneficiary” refers to the intended recipient of the funds raised through a Campaign, who may or may not be the Campaign Organiser.
  • “User” refers to any individual who accesses or uses the Platform in any capacity, including visitors, registered users, Organisers, and Donors.

2.3 Campaign & Content Definitions

  • “Campaign” refers to any fundraising listing, page, or project created on the Platform to solicit donations.
  • “Content” refers to all text, images, videos, graphics, descriptions, comments, updates, and other material posted on the Platform by any User.
  • “Prohibited Campaign” refers to any Campaign that violates these Terms, applicable laws, or the Platform’s community standards.

2.4 Financial & Payment Definitions

  • “Payment Processor” refers to third-party payment services (including but not limited to PayPal, Stripe, and other gateways) used to facilitate monetary transactions on the Platform.
  • “Held Funds” refers to any donations or funds that have been frozen, held, or delayed by Social.fund or a Payment Processor pursuant to these Terms.
  • “Disbursement” refers to the release and transfer of donated funds to a Campaign Organiser or Beneficiary.

2.5 Enforcement & Ecosystem Definitions

  • “Enforcement Action” refers to any action taken by Social.fund under these Terms to suspend, terminate, remove, restrict, investigate, freeze funds, or otherwise regulate Campaigns, accounts, or Content for the purpose of protecting Donors, the Platform, and the integrity of the fundraising ecosystem.
  • “Ecosystem” refers to the collective community of Donors, Campaign Organisers, Beneficiaries, and visitors, together with the trust, safety, and reputational infrastructure that enables effective fundraising on the Platform.
  • “Good Faith” refers to actions taken honestly, with a legitimate purpose, and without intent to defraud, deceive, or cause unjustifiable harm.

Section 3Platform Nature & Fee-Free Model

3.1 Role of the Platform

Social.fund operates as a technology platform that facilitates connections between Campaign Organisers and Donors. We are not a financial institution, broker, fiduciary, investment advisor, charity, escrow service, or non-profit organisation. We do not guarantee the success of any Campaign, the legitimacy of any Campaign Organiser, or the appropriate use of donated funds by any Beneficiary.

3.2 Zero-Fee Promise

Social.fund does not charge any platform fees, service fees, or commissions on donations. We do not solicit or add mandatory “tips” to donation amounts. Donors pay exactly the amount they choose to donate.

3.3 Third-Party Processing Charges

Third-party Payment Processors may impose their own transaction fees, currency conversion charges, chargeback fees, or processing costs, which are beyond Social.fund’s control and are governed by the Payment Processor’s own terms of service. Social.fund is not responsible for any fees levied by Payment Processors.

3.4 Supported Payment Methods

The Platform supports multiple payment processors, including PayPal and other gateways. Campaign Organisers are responsible for setting up and maintaining their own payment processor accounts in good standing. The minimum accepted donation is $1.00 (or equivalent in local currency).

3.5 No Party to Transactions

Social.fund is not a party to the payment transaction between Donor and Campaign Organiser. The contractual relationship for each donation exists between the Donor and the Campaign Organiser (and/or the Payment Processor). Social.fund bears no liability for payment failures, delays, chargebacks, or disputes handled by the Payment Processor.

3.6 Currency & Exchange Rates

Campaigns may accept donations in multiple currencies. Currency conversion rates are determined by the applicable Payment Processor and may differ from published market rates. Social.fund is not responsible for unfavourable exchange rates, conversion fees, or discrepancies in currency conversion.

Section 4Account Registration & Eligibility

4.1 Eligibility Requirements

To create an account or Campaign on Social.fund, you must be at least 18 years of age and have the legal capacity to enter into binding agreements under the laws of your jurisdiction. Minors may not create accounts or Campaigns under any circumstances.

4.2 Registration Accuracy

By registering, you represent and warrant that all information you provide is accurate, current, and complete. You agree to promptly update your account information whenever it changes.

4.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You must use a strong, unique password and enable any additional security measures offered by the Platform.

4.4 Account Responsibility

You agree to accept full responsibility for all activities that occur under your account, whether or not authorised by you. Unauthorised use of your account does not relieve you of liability unless you demonstrate that the unauthorised access was not caused by your negligence.

4.5 Notification of Breach

You must notify Social.fund immediately upon becoming aware of any unauthorised access to or use of your account. Failure to promptly report a breach may result in your continued liability for any actions taken through the compromised account.

4.6 Identity Verification

Social.fund reserves the right, at any time and in its sole discretion, to require identity verification from any User, particularly Campaign Organisers. Verification may include, but is not limited to:

  • Government-issued photo identification (passport, driver’s licence, national ID).
  • Proof of address (utility bill, bank statement dated within 90 days).
  • Documentation supporting the campaign’s stated purpose (medical records, invoices, letters from institutions).
  • Bank account or payment processor account verification.
  • Video or live identity confirmation.
  • Evidence of the Beneficiary’s identity and relationship to the Organiser.

4.7 Consequences of Non-Verification

Failure to comply with verification requests within the time frame specified by Social.fund (default: 14 days) may result in: immediate suspension of your Campaign; withholding or freezing of all associated funds; reduction in Campaign visibility; and/or permanent termination of your account.

4.8 One Account Per Person

Each individual may maintain only one active account on the Platform. Creating multiple accounts to circumvent enforcement actions, verification requirements, or fundraising limits constitutes a violation of these Terms and grounds for immediate termination of all associated accounts.

4.9 Account Inactivity

Accounts that have been inactive for more than 12 consecutive months may be deactivated or deleted at Social.fund’s discretion. Social.fund will attempt to notify the account holder via their registered email address before deactivation.

Section 5Campaign Organiser Obligations & Responsibilities

5.1 Truthfulness and Transparency

Campaign Organisers must ensure that all Campaign descriptions, stories, images, and supporting materials are truthful, accurate, and not misleading in any material respect. You must clearly describe the intended use of funds and identify the Beneficiary. Any material misrepresentation is a violation of these Terms and may subject you to account termination, fund forfeiture, and referral to law enforcement.

5.2 Obligation to Use Funds as Stated

All funds raised through a Campaign must be used exclusively for the stated purpose described on the Campaign page. Diversion of funds for personal gain, unrelated expenses, or purposes other than those stated constitutes fraud and a material breach of these Terms.

5.3 Delivery of Funds to Beneficiary

Where the Beneficiary is a person or entity other than the Campaign Organiser, the Organiser agrees to deliver the raised funds to the designated Beneficiary in a timely manner, generally within 30 days of receiving the disbursement, unless a longer timeline is disclosed on the Campaign page.

5.4 Obligation to Update Donors

Campaign Organisers are expected to provide regular, substantive updates to their Donors regarding the progress of the Campaign and the use of funds. Updates should be posted at least once every 30 days while the Campaign remains active. Failure to post updates for more than 60 days may trigger a review or suspension.

5.5 Obligation to Respond

Organisers must respond in good faith to reasonable enquiries from Donors and from Social.fund regarding the Campaign within 14 days of receipt. Persistent failure to respond is grounds for Enforcement Action.

5.6 Changes in Fund Use

If the intended use of funds materially changes after the Campaign is launched, the Organiser must: (a) update the Campaign page to reflect the new purpose; (b) notify existing Donors of the change; and (c) provide Donors with a reasonable opportunity to request a refund of their donation, where feasible. Failure to disclose material changes constitutes a breach of these Terms.

5.7 Legal Compliance

Campaign Organisers are solely responsible for ensuring their Campaigns comply with all applicable local, state, national, and international laws and regulations, including but not limited to tax laws, charitable solicitation registration, anti-money laundering (AML) regulations, Know Your Customer (KYC) requirements, sanctions compliance, data protection laws, and consumer protection statutes.

5.8 Tax Responsibility

Social.fund does not provide tax, legal, or financial advice. Campaign Organisers and Beneficiaries are solely responsible for determining and fulfilling their tax obligations, including the reporting and payment of any applicable income taxes, gift taxes, or other levies on funds received through the Platform.

5.9 Prohibition on Guaranteeing Returns

Campaign Organisers may not promise, guarantee, or imply any financial return, investment gain, interest payment, or material reward to Donors in exchange for their donation, unless the Campaign is explicitly structured as a rewards-based campaign and clearly discloses the nature and timeline of any rewards.

5.10 Accurate Media

All images, videos, documents, and media uploaded in connection with a Campaign must be genuine, unaltered (except for reasonable formatting), and directly relevant to the Campaign’s stated purpose. The use of stock photos, AI-generated images presented as real, or another person’s likeness without their consent is prohibited.

Section 6Donor Protections & Rights

6.1 Donation Transparency

Social.fund is committed to providing Donors with a transparent giving experience. All Campaign pages display the fundraising goal, the total amount raised to date, and the Campaign description. Donors are encouraged to review Campaign details, organiser history, and updates thoroughly before contributing.

6.2 No Guarantee of Fund Use

While Social.fund requires Campaign Organisers to use funds as described, the Platform cannot and does not guarantee that funds will be used as stated. Social.fund is a technology platform, not a fiduciary, guarantor, or insurer of charitable outcomes. Donors make contributions at their own discretion and risk.

6.3 Donor Due Diligence

Donors are encouraged to exercise their own judgment and conduct their own due diligence before contributing to any Campaign. Social.fund provides tools and information to assist Donors, but does not endorse or validate any Campaign unless explicitly stated.

6.4 Reporting Misuse

Donors who believe that a Campaign is fraudulent, misleading, or that funds are being misused may report the Campaign to Social.fund through our designated support channels. Reports should include the Campaign URL, a description of the concern, and any supporting evidence. All reports are reviewed in accordance with our Complaint & Investigation procedures in Section 12. Social.fund will not disclose the identity of complainants except where required by law.

6.5 Refund Policy — General Rule

Donations made through Social.fund are generally non-refundable. Because payments are processed through third-party Payment Processors and may be immediately disbursed to Campaign Organisers, Social.fund has limited ability to facilitate refunds.

6.6 Refund Policy — Exceptions

In the following exceptional circumstances, Social.fund may, in its sole discretion, assist with refunds or direct the return of held funds to affected Donors:

  • The Campaign has been confirmed as fraudulent following an investigation.
  • A Platform error caused an incorrect donation amount to be processed.
  • Social.fund has frozen funds pursuant to an Enforcement Action and determines that returning funds to Donors is the appropriate outcome.
  • A court of competent jurisdiction or regulatory body orders the return of funds.

6.7 Refund Process

Donors seeking refunds should first contact the Campaign Organiser directly. If the Organiser is unresponsive or unwilling to cooperate, Donors may escalate the matter to Social.fund through the complaint procedure in Section 12. Refunds, where granted, will be processed through the original Payment Processor and may take up to 30 business days.

6.8 Donor Data Protection

Social.fund will not sell, rent, or share Donor personal information with third parties for marketing purposes. Donor information shared with Campaign Organisers is limited to what is strictly necessary to process and acknowledge the donation.

6.9 Anonymity Options

Donors may choose to make their donations anonymously where this feature is available. Anonymous donations will not display the Donor’s name publicly, though Social.fund retains the Donor’s information internally for compliance, fraud prevention, and dispute resolution purposes.

6.10 Donor Tax Responsibility

Donors are solely responsible for determining whether their donations qualify as tax-deductible under applicable law. Social.fund does not issue tax receipts and makes no representations regarding the tax treatment of any donation.

6.11 Donor Protection Through Platform Enforcement

Social.fund actively protects Donors by exercising the enforcement powers described in Sections 8 through 11. Donors acknowledge that Enforcement Actions are undertaken in good faith to protect the Donor community and do not create any fiduciary duty, guarantee of outcome, or liability on the part of Social.fund.

6.12 No Insurance or Guarantee

Donations are not insured, guaranteed, or protected by any government agency or deposit insurance programme. In the event of fraud, Campaign failure, or Organiser misconduct, Donors may lose some or all of their donated funds, and Social.fund bears no liability for such losses.

Section 7Prohibited Campaigns & Content

7.1 Prohibited Campaign Categories

The following types of Campaigns are strictly prohibited on Social.fund:

  • Campaigns for business investment, equity offerings, loans, securities, or any regulated financial activity.
  • Campaigns promoting or facilitating illegal activity, including drug trafficking, human trafficking, money laundering, terrorism financing, or any criminal enterprise.
  • Campaigns containing defamatory, obscene, hateful, discriminatory, or otherwise objectionable content.
  • Campaigns that infringe upon the intellectual property rights, privacy rights, or other legal rights of any third party.
  • Campaigns that are fraudulent, deceptive, or misleading in any material respect.
  • Campaigns intended to fund weapons, ammunition, explosives, or other dangerous materials.
  • Campaigns that promote self-harm, eating disorders, substance abuse, or activities harmful to health or well-being.
  • Campaigns that exploit minors or vulnerable individuals in any manner.
  • Campaigns that violate applicable sanctions, export controls, or trade restrictions.
  • Sham, duplicate, or coordinated Campaigns created to manipulate the Platform’s rankings, visibility, or recommendation systems.
  • Campaigns used as conduits for money laundering, sanctions evasion, or the financing of designated persons or entities.

7.2 Prohibited Content

Users may not post Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, or racially, ethnically, or otherwise objectionable. This includes Content that promotes hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.

7.3 Misleading & Deceptive Practices

The following practices are expressly prohibited on the Platform:

  • Using fake or stolen identities to create Campaigns or accounts.
  • Fabricating or exaggerating medical conditions, emergencies, or hardship circumstances to solicit donations.
  • Using AI-generated images, deepfakes, or manipulated media presented as authentic photographs or videos.
  • Creating fake testimonials, endorsements, or social proof (including fake donation activity).
  • Impersonating another person, organisation, charity, or government entity.
  • Operating “pass-through” Campaigns that collect funds purportedly on behalf of a Beneficiary without the Beneficiary’s knowledge or consent.

7.4 Spam & Manipulation

Users may not engage in spamming, astroturfing, or any form of artificial manipulation of the Platform, including but not limited to: creating duplicate Campaigns; using bots or automated tools to generate donations, views, or shares; posting repetitive or irrelevant content; or engaging in coordinated inauthentic behaviour to artificially promote a Campaign.

7.5 Third-Party Solicitation

Users may not use the Platform to solicit users for third-party services, products, or platforms unrelated to the Campaign’s stated purpose. Campaign pages may not contain advertising, affiliate links, or promotional material for commercial products or services.

7.6 Platform Right to Determine Violations

Social.fund retains sole and absolute discretion to determine whether any Campaign or Content violates these prohibitions. Social.fund is not required to provide detailed reasons for its determination and may rely on automated systems, user reports, third-party intelligence, or its own review processes to identify violations.

7.7 Consequences of Violation

Violations of this Section 7 may result in any one or more of the following: immediate removal of the offending Campaign or Content; suspension or termination of the User’s account; holding or forfeiture of associated funds; reporting to law enforcement or regulatory authorities; and/or legal action by Social.fund to recover damages and enforcement costs.

Conflict, Disaster & Crisis Exploitation — Enhanced Provisions

Sections 7.8 through 7.16 address a specific category of high-risk Campaigns that exploit armed conflicts, wars, natural disasters, refugee crises, and humanitarian emergencies. These provisions are designed to protect Donors from deceptive practices, prevent war profiteering, and maintain the credibility of legitimate crisis fundraising on the Platform.

7.8 Conflict & Disaster Exploitation — Definitions

For the purposes of Sections 7.8 through 7.16, the following additional definitions apply:

  • “Crisis Campaign” refers to any Campaign that references, depicts, or solicits donations in connection with an armed conflict, war, military operation, terrorist attack, natural disaster, famine, epidemic, refugee situation, or other humanitarian emergency, whether ongoing or recent.
  • “Conflict Zone” refers to any geographic area that is currently or has recently been subject to armed conflict, military occupation, siege, bombardment, or significant civil unrest, including but not limited to regions identified by the United Nations, International Committee of the Red Cross, or major international humanitarian agencies.
  • “War Profiteering” refers to the act of exploiting a war, conflict, or humanitarian crisis for personal financial gain by soliciting donations under false, misleading, or unverifiable pretences.
  • “Crisis Exploitation” refers to the deliberate use of graphic, emotionally manipulative, or unverified imagery and narratives from conflicts or disasters to solicit donations when the Campaign Organiser has no verifiable connection to the affected population or no credible means of delivering aid.

7.9 Enhanced Verification for Crisis Campaigns

Due to the elevated risk of fraud, exploitation, and sanctions violations inherent in crisis-related fundraising, all Crisis Campaigns are subject to enhanced verification requirements, which may include any or all of the following:

  • Identity Verification: Full government-issued identification of the Campaign Organiser, verified against the organiser’s claimed location and connection to the crisis.
  • Beneficiary Verification: Documented proof of the Beneficiary’s existence, identity, location, and relationship to the Organiser, including third-party corroboration where possible.
  • Organisational Credentials: If the Campaign claims to be operated by or on behalf of a charitable organisation, NGO, relief agency, or community group, documented proof of the organisation’s registration, operational presence in the affected area, and authorisation to fundraise.
  • Fund Delivery Plan: A credible, documented plan describing how donated funds will be delivered to the intended Beneficiaries, including the banking channels, intermediaries, or logistics providers involved.
  • On-the-Ground Evidence: Photographic or video evidence (with verifiable metadata where possible) demonstrating the Organiser’s or organisation’s actual presence in or direct connection to the affected area.
  • Third-Party References: Contact information for at least one independent third party (such as a journalist, aid worker, medical professional, or community leader) who can confirm the Campaign’s legitimacy.

Social.fund reserves the right to apply these requirements to any Campaign at its sole discretion, and to suspend or hold funds for any Crisis Campaign until all requested verification is satisfactorily completed.

7.10 Prohibited Crisis Campaign Practices

The following practices are expressly prohibited in connection with Crisis Campaigns and constitute grounds for immediate suspension, termination, fund forfeiture, and referral to authorities:

7.10.1 War Profiteering

  • Creating a Campaign that exploits an armed conflict, war, or military operation for personal financial enrichment, where the Organiser has no genuine intention or ability to deliver aid to the stated Beneficiaries.
  • Collecting donations ostensibly for victims of a conflict while diverting funds to the Organiser’s personal accounts, unrelated expenses, or third parties who are not the stated Beneficiaries.
  • Repeatedly creating new Crisis Campaigns following each new escalation, attack, or media cycle to capitalise on heightened public sympathy, without demonstrating the delivery of funds from prior campaigns (“serial crisis fundraising”).
  • Operating Crisis Campaigns from a geographic location that is inconsistent with the claimed crisis area, without transparently disclosing the Organiser’s actual location and their relationship to the Beneficiaries.

7.10.2 Unverifiable Crisis Claims

  • Creating a Campaign that claims to aid victims of a specific conflict, disaster, or refugee crisis but provides no verifiable evidence of the Organiser’s connection to the affected population.
  • Using generic, recycled, or unattributed images of suffering, destruction, or displacement to solicit donations, where the images cannot be verified as genuinely related to the Campaign’s stated purpose.
  • Creating a Campaign with a vague or anonymous Organiser identity (such as using a single character, punctuation mark, number, or generic placeholder as the Organiser name) in connection with a conflict or disaster.
  • Claiming to represent a refugee camp, displaced persons settlement, or humanitarian site without verifiable authorisation from the camp administration, UNHCR, or the relevant national or international agency.

7.10.3 Emotional Exploitation & Manipulative Narratives

  • Using graphic images of dead, injured, or distressed individuals (particularly children) primarily as an emotional manipulation tool to drive donations, especially where the images are sourced from the internet, unrelated events, or prior conflicts.
  • Fabricating or materially exaggerating personal narratives of suffering, displacement, or persecution to solicit sympathy donations.
  • Using politically inflammatory, extremist, or incitement-oriented language in Campaign descriptions that goes beyond legitimate humanitarian appeals and into propaganda, hate speech, or glorification of violence.

7.10.4 Sanctions & Designated Entity Violations

  • Creating a Campaign that directly or indirectly benefits individuals, entities, or organisations designated on sanctions lists maintained by the United States (OFAC SDN List), European Union, United Kingdom, United Nations, or other applicable jurisdictions.
  • Using the Platform to transfer funds into or out of jurisdictions subject to comprehensive sanctions, unless the transaction falls within a recognised humanitarian exemption and is properly documented.
  • Collecting funds that may directly or indirectly benefit armed groups, militias, designated terrorist organisations, or their affiliates, regardless of the humanitarian framing of the Campaign.

7.11 Duplicate & Coordinated Crisis Campaigns

Social.fund has identified patterns of abuse involving the creation of multiple similar or near-identical Crisis Campaigns, which undermine trust and increase fraud risk. The following are expressly prohibited:

  • Duplicate Campaigns: Creating two or more Campaigns with substantially the same description, images, goal, or Beneficiary, whether from the same account or from multiple accounts.
  • Near-Identical Campaigns: Creating Campaigns that vary only in minor cosmetic details (different photos, slightly rephrased titles) but are substantively identical in purpose, geography, and solicitation narrative.
  • Coordinated Campaign Networks: Operating or participating in a network of ostensibly independent Campaigns that share common organisers, IP addresses, payment accounts, device fingerprints, or contact information, with the apparent purpose of multiplying donations or evading detection.
  • Serial Replacement Campaigns: Creating a new Campaign to replace one that was previously suspended or terminated for policy violations, without addressing the underlying issues that led to the prior Enforcement Action.
  • Template Campaigns: Using pre-written, templated Campaign content (particularly in Arabic, French, or other languages) that is copied across multiple accounts with only minimal changes, suggesting coordinated or automated Campaign creation.

Social.fund’s automated systems actively monitor for duplicate and coordinated Campaign patterns. Campaigns identified as duplicates or part of a coordinated network may be immediately suspended, merged, or terminated without notice.

7.12 Anonymous & Vague Organiser Identities

Crisis Campaigns are held to a higher standard of Organiser transparency than general fundraising Campaigns. The following identity practices are prohibited or subject to enhanced scrutiny in connection with Crisis Campaigns:

  • Placeholder Names: Using a single character (e.g., “.”, “0”, “-”), a number, or a generic placeholder as the Organiser name. Crisis Campaigns must identify a real individual or registered organisation.
  • Unverifiable Pseudonyms: Using a name that cannot be corroborated with any form of identification. While Social.fund respects privacy, the heightened fraud risk of Crisis Campaigns requires verifiable Organiser identities.
  • Organisation Names Without Registration: Claiming to represent an organisation (e.g., “Hope for [Region]”, “[Region] Relief”, “Human Appeal”) without providing verifiable registration documents, organisational website, or evidence of genuine operational capacity.
  • Rotating Identities: Using different names, identities, or organisational affiliations across multiple Crisis Campaigns from the same or linked accounts.

Campaigns that fail to meet Organiser identity standards may be demoted in visibility, flagged with a warning label visible to Donors, placed on mandatory fund hold, or suspended pending verification.

7.13 Geographic & Logistical Plausibility

Social.fund may assess the geographic and logistical plausibility of Crisis Campaigns as part of its fraud prevention measures. Factors that may trigger enhanced review include:

  • The Campaign claims to deliver aid in an active war zone, besieged area, or region with severely disrupted financial and logistical infrastructure, but the Organiser provides no credible plan for how funds will reach the Beneficiaries.
  • The Organiser’s IP address, device location, or Payment Processor account location is inconsistent with their claimed geographic connection to the crisis (e.g., the Organiser claims to be in a conflict zone but consistently accesses the Platform from a different country), without transparent disclosure of this arrangement.
  • The Campaign’s requested funding amount is significantly disproportionate to the stated need, the Organiser’s apparent capacity, or typical costs in the affected region.
  • The Campaign provides no credible mechanism for fund transfer to the affected area, or relies on informal, unregulated, or sanctioned transfer channels.
  • Multiple Campaigns from the same region share identical or near-identical payment accounts, contact details, or narrative structures, suggesting coordinated rather than independent fundraising.

7.14 Mandatory Disclosure for Crisis Campaigns

Campaign Organisers creating Crisis Campaigns must clearly and prominently disclose the following information on their Campaign page:

  • The Organiser’s full real name or the registered name of the organising entity.
  • The Organiser’s actual current location, and if different from the crisis area, a clear explanation of their relationship to the affected population.
  • The specific Beneficiary or Beneficiaries, identified by name, group, or location with sufficient detail to allow verification.
  • A clear and detailed description of how funds will be used, including specific allocations (e.g., food, medical supplies, evacuation costs, shelter).
  • The means by which funds will be delivered to the Beneficiaries, including the payment channels, intermediaries, or logistics providers involved.
  • Any affiliation with a registered charity, NGO, or humanitarian organisation, including registration numbers and verifiable contact information.
  • If the Organiser has previously created one or more Crisis Campaigns on Social.fund or any other platform, a disclosure of those prior campaigns and the outcomes (funds raised, funds delivered, Beneficiaries served).

Failure to provide these disclosures may result in reduced Campaign visibility, mandatory fund holds, suspension, or termination.

7.15 Ongoing Monitoring of Crisis Campaigns

Crisis Campaigns are subject to ongoing, heightened monitoring throughout their active period and during fund disbursement, including:

  • Update Requirements: Crisis Campaign Organisers must provide substantive updates at least every 14 days (compared to the standard 30-day interval) demonstrating the receipt and use of funds by the intended Beneficiaries.
  • Proof of Delivery: Social.fund may require Crisis Campaign Organisers to provide documentary evidence (photos, receipts, third-party confirmation) that donated funds or purchased goods have been delivered to Beneficiaries.
  • Phased Disbursement: Social.fund may implement phased or milestone-based fund disbursement for Crisis Campaigns, releasing funds in tranches contingent upon the Organiser demonstrating satisfactory use of previously disbursed amounts.
  • Post-Campaign Audit: Social.fund reserves the right to conduct or commission a post-campaign audit of any Crisis Campaign to verify the use of funds. Organisers agree to cooperate fully with any such audit.
  • Community Feedback Monitoring: Social.fund will monitor Donor comments, reports, and feedback on Crisis Campaigns with heightened sensitivity and may take interim protective measures based on patterns of concern even before a formal complaint is filed.

7.16 Platform Right to Classify & Re-Classify Campaigns

Social.fund reserves the sole and absolute right to classify any Campaign as a Crisis Campaign, regardless of how the Organiser has categorised it, based on the Campaign’s content, imagery, narrative, geographic references, or solicitation language. Once classified as a Crisis Campaign, the enhanced provisions of Sections 7.8 through 7.15 apply automatically. Social.fund’s classification decision is final and not subject to appeal, though the Organiser may address any resulting verification requirements to lift associated restrictions.

Note to Legitimate Crisis Fundraisers

Social.fund recognises and deeply values the work of legitimate individuals and organisations who fundraise to help people affected by wars, conflicts, and natural disasters. These enhanced provisions are not intended to discourage genuine crisis fundraising. Rather, they are designed to protect legitimate fundraisers by removing fraudulent Campaigns that erode Donor trust, and to ensure that Donors can give with confidence that their contributions will reach those in need. Legitimate Crisis Campaign Organisers who cooperate with verification and disclosure requirements will benefit from increased Donor trust and Platform support.

Section 8Platform Enforcement Rights: Suspension, Termination & Payment Holds

Ecosystem Integrity Mandate

To protect the integrity and safety of the Social.fund ecosystem—including Campaign Organisers, Donors, Beneficiaries, and the broader public—Social.fund retains comprehensive enforcement rights as detailed below. By using the Platform, you expressly consent to and accept all enforcement actions described in this section.

8.1 Right to Suspend Campaigns

Social.fund reserves the right to immediately suspend any Campaign, without prior notice, under any of the following circumstances:

  • The Campaign has been reported by one or more users and an investigation is pending.
  • The Campaign appears to violate these Terms, including the Prohibited Campaign categories in Section 7.
  • The Campaign Organiser has failed to respond to a verification request within the stipulated time frame (default: 14 days).
  • Social.fund has reasonable grounds to believe the Campaign is fraudulent, misleading, or operating in bad faith.
  • A law enforcement or regulatory authority has requested the suspension or flagged the Campaign.
  • The Campaign’s content has been materially altered after launch in a manner that misrepresents the original stated purpose.
  • Automated fraud-detection systems have flagged the Campaign for anomalous activity, including rapid or unusual donation patterns, geographic inconsistencies, or velocity triggers.
  • The Campaign has been classified as a Crisis Campaign under Section 7.16 and the Organiser has not completed the enhanced verification requirements of Section 7.9 within the stipulated time frame.
  • The Campaign matches patterns associated with conflict exploitation, war profiteering, or coordinated crisis Campaign networks as described in Sections 7.10 and 7.11.
  • The Campaign Organiser’s identity is anonymous, uses placeholder characters, or cannot be independently verified, in connection with a Crisis Campaign (Section 7.12).

8.1.1 Effects of Suspension

When a Campaign is suspended: (a) the Campaign page will be temporarily hidden from public view; (b) no new donations will be accepted; (c) existing funds may be placed on hold pending investigation; (d) the Campaign Organiser will be notified via their registered email address with the reason for suspension and instructions for resolution; and (e) any active Payment Processor disbursements may be paused.

8.1.2 Duration of Suspension

Suspensions remain in effect until: (a) the investigation is concluded and the Campaign is cleared; (b) the Campaign Organiser satisfies all verification or remediation requirements; or (c) Social.fund determines that the Campaign should be permanently terminated. Social.fund is not obligated to resolve suspensions within any specific timeframe.

8.2 Right to Terminate Campaigns & Accounts

Social.fund reserves the right to permanently terminate any Campaign or user account, with or without prior notice, under any of the following circumstances:

  • Confirmed violation of these Terms of Service after investigation.
  • Repeated or egregious instances of user complaints associated with the Campaign or account.
  • The Campaign Organiser has provided false or misleading identity documentation during verification.
  • The account is being used to engage in or facilitate fraud, money laundering, or other criminal activity.
  • The Campaign Organiser has created multiple accounts to circumvent a prior suspension, ban, or termination (“ban evasion”).
  • Any behaviour that, in Social.fund’s sole and reasonable judgment, poses a risk to the safety, reputation, financial integrity, or operational continuity of the Platform or its users.
  • Failure to cooperate with an ongoing investigation for more than 14 consecutive days after initial contact.

8.2.1 Effects of Termination

Upon termination: (a) the account and all associated Campaigns will be permanently removed from public view; (b) the user will be permanently prohibited from creating new accounts; (c) any funds on hold may be returned to Donors, donated to a reputable charity, held in escrow for a court order, or dealt with as required by applicable law; (d) Social.fund may retain all records of the terminated account indefinitely for compliance, legal defence, and security purposes; and (e) the terminated user forfeits all rights and claims to any held funds except as required by applicable law.

8.2.2 Permanent Ban

A terminated user is permanently banned from the Platform. Any attempt to create a new account, access the Platform through an alias, or use third parties to circumvent the ban constitutes a further violation of these Terms and may result in legal action.

8.3 Right to Hold, Freeze, or Redirect Payments

Social.fund, acting directly or in conjunction with its Payment Processor partners, reserves the right to hold, freeze, delay, or redirect payments under any of the following circumstances:

8.3.1 Payment Holds for Unverified Campaigns

  • If a Campaign Organiser has not completed identity verification, Social.fund may place a hold on all funds raised until satisfactory verification is provided.
  • If a Campaign raises an amount significantly exceeding its stated goal, historical norms, or typical patterns for similar campaigns, a precautionary hold may be applied pending review.
  • If the Campaign is newly created and has not yet established a transaction history, a hold period of up to 30 days may apply before initial fund disbursement.
  • If the Campaign Organiser is located in a jurisdiction flagged for elevated fraud risk or sanctions exposure, enhanced due diligence and extended hold periods may apply.

8.3.2 Payment Holds Due to User Complaints

  • If Social.fund receives credible complaints from Donors regarding a Campaign’s legitimacy or the misuse of funds, payments may be frozen pending a full investigation.
  • If three (3) or more independent complaints are received regarding the same Campaign within any 30-day period, an automatic review and temporary payment hold will be triggered.
  • Funds will not be released until the investigation is concluded to Social.fund’s reasonable satisfaction or a court of competent jurisdiction orders otherwise.

8.3.3 Payment Holds for Legal and Regulatory Compliance

  • Social.fund will comply with all lawful court orders, subpoenas, regulatory directives, government requests, or law enforcement demands that require the freezing, seizure, or redirection of funds.
  • If Social.fund has reasonable grounds to suspect money laundering, terrorism financing, sanctions evasion, or other financial crimes, funds will be immediately held and appropriate authorities notified.

8.3.4 Dispute Resolution Holds

In the event of a dispute between a Donor and a Campaign Organiser, Social.fund may hold the disputed funds for up to 180 days while attempting to mediate a resolution. If no resolution is reached, Social.fund may: return the funds to the Donor; release them to the Campaign Organiser; donate them to a reputable charity; or take other lawful action it deems appropriate.

8.3.5 Interest on Held Funds

Social.fund is not obligated to pay interest on any funds held, frozen, or delayed pursuant to these Terms, except where required by applicable law.

8.4 Right to Remove Listings

Social.fund may, at its sole discretion and without prior notice, remove any Campaign listing from the Platform for any of the following reasons:

  • The Campaign contains false, misleading, or defamatory content.
  • The Campaign has been inactive for more than 90 days with no updates from the Organiser.
  • The Campaign Organiser has been unresponsive to Social.fund communications for more than 14 consecutive days.
  • The Campaign is a duplicate, spam, or an attempt to manipulate the Platform.
  • The Campaign poses legal, regulatory, financial, or reputational risk to Social.fund or its user community.
  • Continuing to host the Campaign would cause harm to Donors or the public interest.

8.4.1 Notification After Removal

Where reasonably practicable, Social.fund will notify the Campaign Organiser of the removal and the reason(s) therefor. However, Social.fund is not obligated to provide advance notice, and in cases involving suspected fraud or law enforcement involvement, notice may be delayed or withheld entirely.

8.5 Ecosystem Protection Measures

Social.fund is committed to maintaining a trusted, safe, and high-integrity fundraising ecosystem. To this end, Social.fund may at any time and without prior notice:

  • Implement automated systems (including machine learning models) to detect potentially fraudulent, suspicious, or policy-violating campaigns based on content analysis, user behaviour, donation velocity, geographic signals, and device fingerprinting.
  • Limit the visibility, searchability, or promotional ranking of Campaigns that have not completed verification or that have received complaints.
  • Establish and enforce fundraising limits, disbursement schedules, or cooling-off periods for new or unverified Campaign Organisers.
  • Share information about confirmed fraudulent campaigns, banned users, and suspicious patterns with Payment Processors, law enforcement, regulators, and other fundraising platforms.
  • Conduct periodic or random audits of active Campaigns to verify compliance.
  • Modify Platform features, ranking algorithms, trust signals, and policies to strengthen ecosystem integrity.
  • Engage third-party fraud detection, identity verification, or compliance services.
  • Publish anonymised transparency reports summarising enforcement actions.

8.5.1 No Obligation to Disclose Methods

Social.fund is not required to disclose the specific algorithms, scoring models, or detection criteria used in its ecosystem protection measures. Disclosure could compromise the effectiveness of these systems and endanger the Platform’s security.

Critical Notice to All Users

All enforcement actions described in this Section 8 are taken at Social.fund’s sole and absolute discretion, exercised in good faith to protect Donors and maintain ecosystem integrity. By using the Platform, you irrevocably consent to these enforcement measures and expressly waive any and all claims against Social.fund arising from the exercise of these enforcement rights, to the fullest extent permitted by applicable law.

Section 9Platform Immunity & Safe Harbour for Enforcement Actions

9.1 Good-Faith Enforcement Immunity

Social.fund, its officers, directors, employees, agents, and affiliates shall not be liable to any User or third party for any loss, damage, cost, or expense arising from or related to any Enforcement Action taken in good faith under these Terms. This immunity applies regardless of whether the Enforcement Action is ultimately determined to have been based on incomplete information, a good-faith error, or a complaint later found to be without merit.

9.2 Scope of Protected Actions

The immunity in Section 9.1 extends to, without limitation:

  • Suspension or removal of any Campaign for any reason permitted under these Terms.
  • Temporary or permanent termination of any user account.
  • Holding, freezing, delaying, or redirecting any payments or funds.
  • Reducing the visibility, ranking, or discoverability of any Campaign.
  • Requesting identity verification or additional documentation.
  • Sharing information with law enforcement, regulators, Payment Processors, or other platforms.
  • Modifying or removing any user Content.
  • Returning held funds to Donors or donating them to charity.
  • Denying account creation or Campaign publication.
  • Any other action taken to protect Donors, the Platform, or the ecosystem.

9.3 No Duty to Act

Nothing in these Terms creates an obligation on the part of Social.fund to take any Enforcement Action, investigate any complaint, monitor any Campaign, verify any user, or protect any Donor from loss. Social.fund’s enforcement rights are discretionary, not mandatory.

9.4 No Liability for Non-Enforcement

Social.fund shall not be liable for any failure to detect, investigate, or take action against a fraudulent, misleading, or prohibited Campaign. The existence of enforcement tools does not constitute a warranty that all violations will be identified or addressed.

9.5 No Liability for Third-Party Actions

Social.fund shall not be liable for any actions taken by Payment Processors, law enforcement agencies, regulatory bodies, banks, or other third parties in connection with or as a result of information shared by Social.fund pursuant to these Terms or applicable law.

9.6 Statutory Safe Harbour

To the extent applicable, Social.fund claims the protections of Section 230 of the Communications Decency Act (47 U.S.C. § 230), which provides immunity for interactive computer service providers from liability for third-party content and for good-faith content moderation actions.

9.7 International Safe Harbour Provisions

For Users located outside the United States, Social.fund additionally claims the benefit of any analogous safe harbour, intermediary liability exemption, or platform immunity provisions available under the laws of the User’s jurisdiction, including but not limited to the EU Digital Services Act (DSA), the UK Online Safety Act, and similar legislation.

Section 10Class Action Waiver & Collective Claim Prohibition

Please Read Carefully — This Section Affects Your Legal Rights

This section contains a class action waiver, a collective action waiver, and restrictions on how you may bring claims against Social.fund. By using the Platform, you agree to resolve all disputes on an individual basis only.

10.1 Absolute Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE, CLAIM, OR CAUSE OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THE PLATFORM, ANY ENFORCEMENT ACTION TAKEN BY SOCIAL.FUND, OR ANY ASPECT OF YOUR RELATIONSHIP WITH SOCIAL.FUND SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU HEREBY IRREVOCABLY WAIVE THE RIGHT TO:

  • Participate in a class action, class-wide arbitration, or any class or representative proceeding against Social.fund.
  • Serve as a class representative or member of any putative class.
  • Join, consolidate, or combine your claim with the claims of any other person or entity.
  • Seek or obtain any form of class-wide, collective, or representative relief.

10.2 Waiver of Collective Claims Arising from Enforcement Actions

You specifically acknowledge that Social.fund’s Enforcement Actions are taken to protect Donors and preserve ecosystem integrity. You agree that:

  • You will not initiate, join, or participate in any collective, consolidated, or multi-party legal action against Social.fund arising from any Enforcement Action.
  • You will not seek to represent, or purport to act on behalf of, other Users in any proceeding against Social.fund relating to Enforcement Actions.
  • You will not fund, organise, encourage, or facilitate any collective legal action by other Users against Social.fund.
  • If a court determines this waiver is unenforceable for a particular claim, that claim shall be severed and litigated individually; all others remain subject to this waiver.

10.3 Claims by Campaign Organisers Whose Campaigns Are Terminated

If your Campaign is suspended, terminated, or removed, you agree that:

  • Your sole and exclusive remedy is to file an individual appeal through Social.fund’s support channels within 30 days of the Enforcement Action.
  • You waive all class-wide, collective, or representative claims arising from the Enforcement Action.
  • You waive any claim for consequential, punitive, special, or exemplary damages.
  • Your maximum recoverable damages shall be limited to the amount of verified funds held by Social.fund at the time of the action, less amounts lawfully disbursed, returned, or donated.
  • You acknowledge that the Enforcement Action does not constitute defamation, tortious interference, or breach of contract, and you waive any such claims to the fullest extent permitted by law.

10.4 Claims by Donors Regarding Enforcement Outcomes

Donors acknowledge and agree that:

  • Social.fund’s enforcement powers are exercised in good faith but do not guarantee fund recovery, fraud prevention, or specific outcomes.
  • Donors waive any class action or collective claim against Social.fund arising from: the failure to detect or prevent a fraudulent Campaign; the timing or manner of any Enforcement Action; the disposition of frozen or held funds; or any loss suffered from donating to a Campaign.
  • Donors’ sole individual remedy is limited to the return of their individual donation amount from funds actually held by Social.fund, if any, to the extent available after legal obligations are satisfied.

10.5 Prohibition on Litigation Funding Against Social.fund

Users agree not to accept, solicit, or facilitate third-party litigation funding for the purpose of bringing class action, collective, or representative claims against Social.fund. Any such funded action is deemed a violation of these Terms and may be raised by Social.fund as a defence or grounds for dismissal.

10.6 Survival of Class Action Waiver

This class action and collective claim waiver shall survive the termination of your account, the termination of these Terms, the removal of your Campaign, and any other cessation of your relationship with Social.fund. It applies to all claims, whether arising in contract, tort, statute, equity, or any other legal theory.

Section 11Enforcement Actions — Comprehensive Liability Shield

11.1 Purpose and Scope

This section establishes a comprehensive liability framework for all Enforcement Actions taken by Social.fund to protect Donors, prevent fraud, maintain ecosystem trust, and comply with legal obligations. These protections are in addition to, and do not limit, the protections in Sections 9, 10, 15, and 16.

11.2 Absolute Discretion in Enforcement

Social.fund retains absolute and sole discretion to determine: (a) whether to initiate an investigation; (b) what evidence is sufficient; (c) the type, severity, and duration of any Enforcement Action; (d) whether to provide advance notice; (e) the disposition of held funds; and (f) whether to reinstate a suspended Campaign or account. Social.fund’s decisions are final and binding, subject only to applicable law.

11.3 No Liability for Enforcement Decisions

To the fullest extent permitted by law, Social.fund shall not be liable for:

  • Over-enforcement: Loss suffered by an Organiser as a result of a suspension, termination, or hold that was later found unnecessary, provided the action was taken in good faith.
  • Under-enforcement: Loss suffered by a Donor or third party as a result of Social.fund’s failure to detect or take action against a fraudulent Campaign.
  • Delayed enforcement: Loss suffered due to the timing of an Enforcement Action, including where funds were disbursed before fraud was detected.
  • Third-party actions: Loss arising from actions by Payment Processors, law enforcement, or regulators in connection with information shared by Social.fund.
  • Collateral effects: Any indirect, incidental, or consequential harm, including lost donations, reputational harm, emotional distress, or lost business opportunities.
  • Algorithmic decisions: Loss arising from automated fraud detection, content moderation, or risk-scoring systems, even if the automated decision was subsequently found to be inaccurate.

11.4 No Fiduciary Duty

Nothing in these Terms creates or implies a fiduciary duty, duty of care, agency relationship, partnership, joint venture, or employment relationship between Social.fund and any User. Social.fund acts solely as a technology platform provider.

11.5 Donor Ecosystem Protection — Affirmative Defence

In any legal proceeding brought against Social.fund arising from an Enforcement Action, Social.fund may assert as an affirmative defence that the action was taken to protect Donors and preserve ecosystem integrity. Prima facie evidence of good faith includes:

  • User complaints or reports regarding the Campaign.
  • Flags generated by automated fraud-detection or compliance systems.
  • The Organiser’s failure to respond to verification or communication requests.
  • Anomalous donation patterns, geographic inconsistencies, or other fraud indicators.
  • Requests or directives from law enforcement, regulators, or Payment Processors.
  • Matching patterns associated with known fraud typologies.
  • Any other reasonable basis documented at the time of the action.

11.6 Injunctive Relief & Equitable Remedies

You acknowledge that a breach of these Terms may cause irreparable harm to Donors and Social.fund for which monetary damages are inadequate. Social.fund shall be entitled to seek injunctive relief, specific performance, and other equitable remedies without posting a bond or proving actual damages, in addition to any other remedies available at law or equity.

11.7 Recovery of Enforcement Costs

If Social.fund incurs costs in connection with an Enforcement Action that results in a confirmed violation—including investigation costs, legal fees, forensic analysis, chargeback fees, and compliance costs—Social.fund reserves the right to recover such costs from the violating User, including by deducting them from held funds.

11.8 Cooperation Obligation

All Users agree to cooperate fully with any investigation or Enforcement Action, including: responding to enquiries within 14 days; providing requested documentation; making oneself available for verification; and not destroying or concealing relevant evidence. Failure to cooperate constitutes a separate violation and may result in adverse inferences, termination, and fund forfeiture.

11.9 Record Retention for Defence

Social.fund may retain records of all Enforcement Actions, investigations, user complaints, account data, transaction records, and communications indefinitely for the purpose of legal defence, regulatory compliance, law enforcement cooperation, fraud prevention research, and Platform security, even after account termination.

11.10 Subrogation Rights

Where Social.fund returns funds to Donors as a result of an Enforcement Action against a Campaign Organiser, Social.fund shall be subrogated to the Donors’ rights against the Campaign Organiser to the extent of the funds returned, and may pursue recovery from the Campaign Organiser in its own name or on behalf of affected Donors.

Section 12Complaint & Investigation Procedures

12.1 Filing a Complaint

Any User may file a complaint regarding a Campaign or another User by contacting Social.fund through its designated support channels. Complaints should include: the Campaign URL or user in question; a detailed description of the concern; and any supporting evidence (screenshots, communications, receipts, etc.).

12.2 Acknowledgement of Complaints

Social.fund will endeavour to acknowledge receipt of complaints within a reasonable timeframe. Acknowledgement does not constitute an admission that the complaint is valid or that action will be taken.

12.3 Preliminary Review

Upon receipt, Social.fund will conduct a preliminary review to assess the credibility, severity, and urgency of the complaint. Complaints deemed credible and material will proceed to a full investigation.

12.4 Interim Protective Measures

During the investigation, Social.fund may take interim measures including: suspending the Campaign; freezing associated funds; restricting the Organiser’s account functionality; and/or reducing Campaign visibility. These measures are precautionary and do not constitute a determination of guilt or liability.

12.5 Full Investigation

A full investigation may include: requesting documentation from the Campaign Organiser; contacting the complainant for additional information; reviewing donation and disbursement records; consulting with Payment Processors; engaging third-party verification or forensic services; and/or coordinating with law enforcement where appropriate.

12.6 Investigation Outcomes

Following an investigation, Social.fund may take one or more of the following actions:

  • Reinstate the Campaign if the complaint is without merit.
  • Require the Organiser to modify Campaign content or provide additional documentation.
  • Issue a formal warning to the Campaign Organiser.
  • Permanently terminate the Campaign and/or the Organiser’s account.
  • Refund affected Donors in whole or in part from held funds.
  • Donate unclaimed or disputed funds to a reputable charity.
  • Refer the matter to law enforcement or regulatory authorities.
  • Publish a notice to Donors of the affected Campaign informing them of the outcome.

12.7 Appeals Process

Campaign Organisers subject to an Enforcement Action may submit a written appeal to Social.fund within 30 days of the action. Appeals must include a detailed explanation and supporting evidence. Social.fund will review appeals and respond within a reasonable timeframe. The appeal decision is final and not subject to further review.

12.8 Confidentiality of Investigations

Social.fund will treat the details of investigations as confidential and will not disclose investigation specifics to third parties except: to the extent necessary to conduct the investigation; as required by law, court order, or regulatory demand; to Payment Processors to facilitate fund holds or returns; or to law enforcement agencies.

12.9 Protection Against Retaliatory Complaints

Users who file complaints in good faith will not be penalised or subjected to retaliation. However, Users who file knowingly false, malicious, or vexatious complaints may be subject to Enforcement Action, including account termination.

12.10 No Obligation to Investigate

Social.fund is under no legal obligation to investigate every complaint, respond within any specific timeframe, or take action on every report. Social.fund exercises sole judgment in these determinations.

Section 13Intellectual Property

13.1 Platform Intellectual Property

The Platform, including its design, features, functionality, source code, algorithms, graphics, trademarks, trade dress, logos, and all associated intellectual property, is and remains the exclusive property of Social.fund and its licensors. These are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

13.2 Restrictions on Use

You may not copy, reproduce, modify, distribute, reverse engineer, decompile, disassemble, create derivative works of, or commercially exploit any Platform materials or intellectual property without prior written consent from Social.fund.

13.3 User Content Licence

By posting Content on the Platform, you grant Social.fund a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to use, display, reproduce, modify, adapt, and distribute such Content in connection with the operation, promotion, and improvement of the Platform.

13.4 Ownership of User Content

You retain ownership of your Content. However, you are solely responsible for ensuring that your Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

13.5 DMCA & Copyright Claims

Social.fund respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). Copyright infringement claims may be submitted to dmca@social.fund with the information required under 17 U.S.C. § 512(c)(3).

13.6 Repeat Infringer Policy

Social.fund maintains a policy of terminating the accounts of Users who are repeat copyright infringers, in accordance with the DMCA and applicable law.

13.7 Feedback

If you provide Social.fund with any suggestions, ideas, feedback, or recommendations regarding the Platform (“Feedback”), you grant Social.fund an unrestricted, irrevocable, perpetual, royalty-free licence to use such Feedback for any purpose without obligation or compensation to you.

Section 14Privacy & Data Protection

14.1 Governing Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.

14.2 Data Collection

We collect only the personal information necessary to operate the Platform and facilitate fundraising, including but not limited to: name, email address, IP address, browser information, device identifiers, and transaction data.

14.3 Data Security

We use industry-standard security measures to protect your data, including encryption in transit (TLS/SSL) and at rest. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

14.4 No Sale of Personal Data

We do not sell your personal information to third parties for marketing purposes. We may share data with service providers, Payment Processors, and legal authorities as described in the Privacy Policy.

14.5 Regulatory Compliance

We comply with applicable data protection laws, including GDPR (for EU/EEA users), CCPA (for California residents), and other regional regulations where applicable.

14.6 Data Subject Rights

You have the right to request access to, correction of, portability of, or deletion of your personal data, subject to legal retention requirements, legitimate business interests, and ongoing legal proceedings or investigations.

14.7 Enforcement Data Retention

Social.fund may retain data related to Enforcement Actions, investigations, complaints, and terminated accounts indefinitely for compliance, legal defence, fraud prevention, and safety purposes, even after you request account deletion.

14.8 Cookies & Tracking

The Platform uses cookies and similar tracking technologies as described in our Privacy Policy. You can manage cookie preferences through your browser settings, though disabling cookies may affect Platform functionality.

Section 15Limitation of Liability

15.1 No Liability for Campaigns

Social.fund is not responsible for the actions, omissions, or representations of Campaign Organisers, Beneficiaries, or Donors. We do not endorse, verify, or guarantee any Campaign and are not liable for any loss arising from your reliance on Campaign information or your decision to donate.

15.2 No Liability for User Interactions

Social.fund is not liable for any disputes, damages, or losses arising from interactions between Users, including disputes between Donors and Campaign Organisers regarding the use of funds.

15.3 Maximum Aggregate Liability — Fees-Paid Model

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SOCIAL.FUND’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THE PLATFORM, ANY ENFORCEMENT ACTION, OR ANY ASPECT OF YOUR RELATIONSHIP WITH SOCIAL.FUND, SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU DIRECTLY TO SOCIAL.FUND (EXCLUDING ANY AMOUNTS PAID TO THIRD-PARTY PAYMENT PROCESSORS, CAMPAIGN ORGANISERS, OR OTHER THIRD PARTIES) IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15.4 Zero-Fee Intermediary Acknowledgement

You expressly acknowledge and agree that:

  • Social.fund charges no fees. Social.fund does not charge platform fees, service fees, commissions, tips, or any other charges to Users. Accordingly, under the Fees-Paid Model described in Section 15.3, the maximum aggregate liability of Social.fund will be zero dollars ($0.00) unless and until Social.fund introduces optional paid features in the future.
  • Social.fund is a connecting platform only. Social.fund does not receive, hold, process, or take custody of donated funds at any point. All payment transactions occur directly between the Donor and the Campaign Organiser through independent third-party Payment Processors (such as PayPal or Stripe). Social.fund’s role is limited to providing the technology infrastructure that enables Campaign Organisers and Donors to connect.
  • The liability cap reflects the economic reality. You agree that because Social.fund provides its Platform entirely free of charge and derives no revenue from your transactions, a liability cap tied to fees paid is fair, reasonable, and proportionate. You voluntarily accept this limitation as a material condition of your free access to the Platform.
  • No unjust enrichment. Because Social.fund does not profit from any donation transaction, no claim for unjust enrichment, restitution, or disgorgement of profits may be sustained against Social.fund in connection with any donation, Campaign, or Enforcement Action.
Plain-Language Summary

Social.fund is free. We don’t charge you anything and we don’t touch your money — PayPal and Stripe handle that directly. Because we earn nothing from your use of the Platform, our maximum legal liability is capped at what you’ve paid us, which is $0. If we ever introduce optional paid features, the cap would adjust to reflect what you actually paid.

15.5 Exclusion of Consequential Damages

IN NO EVENT SHALL SOCIAL.FUND BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, REPUTATION, USE, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15.6 Third-Party Service Liability

Social.fund is not liable for any failure, interruption, error, delay, or security breach in third-party services, including Payment Processors, cloud hosting providers, or linked websites.

15.7 Force Majeure

Social.fund shall not be liable for any delay or failure in performance arising from circumstances beyond its reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, government action, power outages, internet disruptions, cyberattacks, or Payment Processor downtime.

15.8 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, Social.fund’s liability shall be limited to the minimum extent permitted by applicable law.

15.9 Essential Purpose

The limitations in this Section 15 apply even if any limited remedy provided herein is found to have failed of its essential purpose.

Section 16Indemnification

16.1 General Indemnification

You agree to indemnify, defend, and hold harmless Social.fund and its officers, directors, employees, contractors, agents, licensors, successors, and assigns from any and all claims, demands, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use of or access to the Platform.
  • Your violation of these Terms or any applicable law.
  • Your violation of any third-party right, including intellectual property, privacy, or contractual rights.
  • Any Content you submit, post, or transmit through the Platform.
  • Any Campaign you create, manage, promote, or contribute to.
  • Any dispute between you and another User.

16.2 Campaign-Specific Indemnification

Campaign Organisers additionally agree to indemnify Social.fund against:

  • Any third-party claim arising from the Campaign’s fundraising activity, including claims by Donors, Beneficiaries, government agencies, or regulators.
  • Any claim that the Campaign is fraudulent, misleading, or in violation of applicable law.
  • Any tax liability, penalty, or interest arising from the Organiser’s failure to comply with tax obligations.
  • Any chargeback, dispute, or reversal initiated by Donors or Payment Processors.

16.3 Enforcement-Related Indemnification

You agree to indemnify Social.fund against any costs, losses, or damages arising from:

  • Your failure to comply with a verification request, investigation, or Enforcement Action.
  • Any misrepresentation made by you in connection with your use of the Platform.
  • Any legal proceedings brought by third parties against Social.fund as a result of your actions on the Platform.

16.4 Defence and Control

Social.fund reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with Social.fund in asserting any available defences.

16.5 Survival

This indemnification obligation survives the termination of your account and these Terms.

Section 17Disclaimers

17.1 “As Is” Disclaimer

17.2 No Warranty of Availability

Social.fund does not warrant that the Platform will be available at all times or operate without interruption, delay, or error.

17.3 No Warranty of Accuracy

Social.fund does not warrant that Campaign information, user profiles, donation totals, or any other data on the Platform is accurate, complete, current, or reliable.

17.4 No Warranty of Security

Social.fund does not warrant that the Platform is free of viruses, malware, or other harmful components, or that it is immune to hacking, data breaches, or other security threats.

17.5 No Warranty of Enforcement Effectiveness

Social.fund does not warrant that its enforcement tools, fraud detection systems, or moderation processes will prevent all fraud, misuse, or policy violations on the Platform.

17.6 No Warranty of Results

Social.fund does not warrant that any Campaign will achieve its fundraising goal, that Donors will contribute, or that the use of the Platform will meet your expectations.

17.7 Third-Party Content

All Campaign content, descriptions, images, and updates are created by Users and do not represent the views, opinions, or endorsements of Social.fund.

Section 18Dispute Resolution & Governing Law

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18.2 Informal Resolution

Before initiating any formal proceeding, you agree to attempt to resolve any dispute informally by contacting Social.fund through its support channels. The parties shall make good-faith efforts to resolve the dispute within 30 days of written notice.

18.3 Binding Arbitration

If informal resolution fails, any dispute shall be resolved through final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall be conducted in Cook County, Illinois, unless the parties agree otherwise.

18.4 Arbitration Procedures

The arbitrator shall have exclusive authority to resolve all disputes, including the scope and enforceability of this arbitration provision. The arbitrator’s award shall be final and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs, and the arbitrator may not award class-wide, collective, or representative relief.

18.5 Class Action Waiver (Reiteration)

As stated in Section 10, all disputes shall be resolved on an individual basis. You waive any right to participate in a class action, class-wide arbitration, or collective proceeding against Social.fund.

18.6 Limitation Period

Any claim arising out of these Terms or the Platform must be filed within one (1) year after the cause of action first accrues. Claims filed after this period are permanently barred, except where prohibited by applicable law.

18.7 Equitable Relief Exception

Notwithstanding the foregoing, Social.fund may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement, misappropriation, or violation of Social.fund’s intellectual property, data security, or user safety, without the requirement to first pursue arbitration.

18.8 Small Claims Exception

Either party may bring qualifying claims in small claims court in Cook County, Illinois (or the county of your residence), provided the claim falls within the court’s jurisdictional limits and remains on an individual basis.

Section 19Communications & Electronic Notices

19.1 Consent to Electronic Communications

By creating an account, you consent to receive electronic communications from Social.fund, including account notifications, Campaign updates, security alerts, investigation-related correspondence, and administrative messages.

19.2 Marketing Communications

You may opt in to receive newsletters and promotional content, from which you may unsubscribe at any time by following the instructions in each communication.

19.3 Essential Communications

Essential communications related to your account, Enforcement Actions, investigations, legal notices, and security alerts cannot be opted out of and will be delivered to your registered email address.

19.4 Deemed Receipt

Notices sent by Social.fund to your registered email address shall be deemed received 24 hours after sending. It is your responsibility to maintain a valid and monitored email address on your account.

Section 20Third-Party Links & Platform Redirects

20.1 Third-Party Websites

The Platform may contain links to third-party websites or services not owned or controlled by Social.fund. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites.

20.2 No Endorsement

The inclusion of any link on the Platform does not imply endorsement, sponsorship, or recommendation by Social.fund. You access third-party sites at your own risk.

20.3 Platform Redirects

Social.fund reserves the right to redirect users to other pages within the Platform or affiliated domains for purposes of platform support, awareness, fundraising, or informational messaging, consistent with our mission and privacy practices.

20.4 Embedded Content

Some Campaign pages may contain embedded content from third-party sources (such as videos or maps). This embedded content is subject to the third party’s terms and privacy policy, not Social.fund’s.

Section 21Modification of Terms

21.1 Right to Modify

Social.fund reserves the right to modify, amend, or replace these Terms at any time and in its sole discretion.

21.2 Notice of Material Changes

If a modification is material, we will provide at least 30 days’ notice before the new terms take effect. Notice may be via email, a banner on the Platform, or other reasonable means.

21.3 Determination of Materiality

What constitutes a “material change” is determined at Social.fund’s sole discretion. Changes to the class action waiver, arbitration clause, limitation of liability, or enforcement rights will always be treated as material.

21.4 Acceptance Through Continued Use

Your continued use of the Platform following the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new terms, you must discontinue using the Platform.

21.5 Prior Versions

Social.fund may make prior versions of these Terms available for reference but is not obligated to do so. The most current version posted on the Platform supersedes all prior versions.

Section 22Severability & Entire Agreement

22.1 Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

22.2 Class Action Waiver Severability

If the class action waiver in Section 10 is found unenforceable with respect to a particular claim, only that specific claim shall be severed; all other claims remain subject to individual resolution and arbitration.

22.3 Entire Agreement

These Terms, together with the Privacy Policy and any additional policies published on the Platform, constitute the entire agreement between you and Social.fund and supersede all prior agreements, understandings, representations, and communications, whether written or oral.

22.4 No Waiver

Social.fund’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any provision shall only be effective if made in writing and signed by Social.fund.

22.5 Assignment

You may not assign or transfer these Terms or any rights hereunder without Social.fund’s prior written consent. Social.fund may assign these Terms in whole or in part without restriction, including in connection with a merger, acquisition, or sale of assets.

22.6 Survival

All provisions that by their nature should survive termination shall survive, including but not limited to Sections 9 (Platform Immunity), 10 (Class Action Waiver), 11 (Liability Shield), 13 (Intellectual Property), 15 (Limitation of Liability), 16 (Indemnification), 17 (Disclaimers), and 18 (Dispute Resolution).
